Terms of Service

These Terms of Service ("Terms") govern your access to and use of tldl.fm ("the Service"), operated by Surf Not Work ("we", "us", or "our"). By creating an account or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this age requirement. Users in the European Union must be at least 16 years old as required under GDPR. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
2. Account Registration
The Service supports account creation and authentication via Google OAuth and Sign in with Apple. By signing in with either method, you authorize us to collect the profile information described in our Privacy Policy. On iOS, Sign in with Apple is available as an authentication option as required by Apple's App Store guidelines. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. You must notify us immediately at support@tldl.fm if you suspect unauthorized access to your account.
You may not create accounts using automated methods, create accounts on behalf of others without authorization, or attempt to circumvent the Service's access controls.
3. Description of the Service
tldl.fm is a web application that allows users to subscribe to podcast RSS feeds and receive AI-generated episode summaries via email digest. The Service automatically fetches new episodes from user-submitted podcast feeds, generates structured summaries using artificial intelligence, and delivers those summaries to the user's registered email address on a user-selected schedule.
The Service is provided on a subscription basis. A free tier with limited features is available. A paid "Pro" tier with expanded features is available at the price listed on our pricing page at the time of subscription.
4. AI-Generated Content — Important Disclaimer
Summaries generated by the Service are produced by artificial intelligence and are intended as convenient overviews only. They are not transcripts, are not guaranteed to be accurate, complete, or free of error, and should not be relied upon as a substitute for listening to the original episode.
In particular:
- AI-generated summaries may contain factual errors, omissions, misattributions, or misrepresentations of statements made in the original episode.
- The Service does not verify, fact-check, or editorially review generated summaries before delivery.
- Summaries reflect the AI model's interpretation of available episode metadata and show notes, which may themselves be incomplete or inaccurate.
- You should not make financial, medical, legal, or other significant decisions based solely on summary content.
We expressly disclaim any liability for decisions made or actions taken in reliance on AI-generated summary content.
5. Third-Party Content and RSS Feeds
The Service fetches and processes content from third-party podcast RSS feeds. All podcast audio, show notes, and associated content remain the intellectual property of the respective podcast creators and rights holders. tldl.fm does not claim ownership of any third-party content.
By submitting a podcast RSS feed URL to the Service, you represent and warrant that:
- You have the right to access the feed (i.e., you are not submitting credentials or URLs to private, paywalled, or access-restricted feeds that you are not authorized to share with third-party services).
- Your use of the summaries generated from that feed complies with applicable law and any terms of service of the podcast provider.
We generate summaries as transformative, AI-produced derivative works for the personal use of our subscribers. We do not reproduce, redistribute, or publish original podcast audio or full transcripts. However, we make no representation that the generation of summaries constitutes fair use or otherwise does not infringe any third party's intellectual property rights in any specific jurisdiction. 6. User Conduct
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Submit podcast feeds containing unlawful, defamatory, or harmful content for the purpose of generating summaries thereof.
- Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use.
- Interfere with or disrupt the Service's infrastructure or security.
- Share, resell, or commercially redistribute summaries generated by the Service without our written permission.
- Use the Service in any way that could damage, overburden, or impair the Service.
7. Subscriptions and Billing
The Pro tier is a recurring subscription billed monthly or annually as selected at checkout. Billing is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription price until you cancel.
Subscription prices may change. We will provide at least 30 days' notice of any price increase via email to your registered address. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.
You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the end of the paid period. We do not issue partial refunds for unused time within a billing period except as described in our Refund Policy or as required by law.
8. Free Tier
The free tier is provided at no charge and is subject to the feature limitations described on our pricing page. We reserve the right to modify free tier features, limits, or availability at any time with reasonable notice. Continued use of the Service after such changes constitutes your acceptance of the modified free tier terms.
9. Email Communications
By creating an account, you consent to receive transactional emails related to your account (account confirmations, billing receipts, security notices) and digest emails containing AI-generated episode summaries for the podcasts you have subscribed to. You may adjust or disable digest emails at any time via your account settings or by using the unsubscribe link in any digest email. Disabling digest emails does not delete your account.
We comply with applicable email laws including the CAN-SPAM Act (United States) and Canada's Anti-Spam Legislation (CASL). Each digest email will include our physical mailing address and an unsubscribe mechanism as required by law.
10. Intellectual Property
The Service, including its software, design, branding, and all original content produced by us, is owned by Surf Not Work and protected by copyright, trademark, and other applicable intellectual property laws. You may not copy, reproduce, modify, or create derivative works of the Service or its original content without our express written permission.
AI-generated summaries delivered to you through the Service are provided for your personal use only. You may share individual summaries for personal, non-commercial purposes. Commercial redistribution of summaries requires our written consent.
11. Termination
We may suspend or terminate your account and access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if continued provision of the Service to you is no longer commercially or technically feasible.
You may terminate your account at any time by contacting us at [SUPPORT EMAIL] or using the account deletion feature in your settings. Upon termination, your data will be handled as described in our Privacy Policy.
Sections 4, 5, 10, 12, 13, and 14 of these Terms survive termination.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT AI-GENERATED SUMMARIES WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL [YOUR LEGAL ENTITY NAME], ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of California, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration in San Luis Obispo County under the rules of Just Resolutions Mediation, except that either party may seek injunctive relief in a court of competent jurisdiction.
If you are a consumer in the European Union, nothing in these Terms affects your statutory rights under EU consumer protection law, and you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email to your registered address at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service before the effective date.
